1. Acceptance of Terms

By accessing or using Smart Guitar (the "Service"), operated by Ilia German ("Company", "we", "us"), available at smart-guitar.com and app.smart-guitar.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Smart Guitar is a web-based application operated by Ilia German that allows users to search for songs, separate audio into individual instrument stems using AI, detect chords, and practice music. The Service is provided on a subscription basis.

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

4. Subscriptions and Payments

Paid features are available through subscription plans processed by our payment partner, Paddle. By subscribing, you agree to Paddle's terms of service in addition to these Terms. Subscription fees are billed in advance on a recurring basis. You may cancel at any time; see our Refund Policy for details.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content you do not have the right to use
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Resell, redistribute, or sublicense access to the Service
  • Use automated tools to scrape or bulk-download content

6. Intellectual Property

The Service, including its design, code, and AI models, is owned by Ilia German (operating as Smart Guitar). You retain ownership of any content you upload. By uploading content, you grant Smart Guitar a limited license to process it solely for the purpose of providing the Service to you.

7. Third-Party Content

Smart Guitar may integrate with third-party services (e.g., YouTube for song search). We do not host or store copyrighted music. You are responsible for ensuring your use of such content complies with applicable laws and the terms of the respective rights holders.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated results (stems, chords, tabs, lyrics) will be perfectly accurate.

9. Limitation of Liability

To the maximum extent permitted by law, Ilia German (operating as Smart Guitar) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Smart Guitar operates, without regard to conflict of law principles.
